DISCLAIMER. CU is a medical tourism company that works independently, facilitating the obtaining of medical services provided by healthcare professionals who are not employed by CU. Reliance on any information or referral by CU is Your and/or the Patient’s sole responsibility and CU assumes no liability or responsibility for the advice, services, and opinions provided. Neither CU nor any of its employees provide medical advice or medical service or endorse or select any healthcare providers. CU is only responsible for the coordination of services that are not medically related. You understand that CU and its employees are not medical doctors, and you are not deciding on a medical procedure based on anything implied by them. Making the decision to receive a medical procedure is based on your own research and advice from medical personnel. You understand that any disputes or claims arising from the procedures and medical services provided are to be brought against the medical facilities, medical staff, or surgeons in Mexico. CU asks that you do not post any messages with misleading, false, or inappropriate language or statements. CU reserves the right to remove any offensive or fraudulent content at any time without your consent. When you place materials or information on the CU Site that is available publicly, you grant CU an irrevocable, perpetual license to use that information. For example, CU has the right to display comments that you post on its Site at the CU’s discretion. This Agreement does not transfer from CU to you any CU or third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with CU. CIBA USA, ciba-usa.com, the CIBA USA logo, and all other trademarks, service marks, graphics and logos used in connection with ciba-usa.com, or the Website are trademarks or registered trademarks of CU or CU ‘s licensors. Other trademarks, service marks, graphics and logos used in connection with the Site may be the trademarks of other third parties. Your use of the Site grants you no right or license to reproduce or otherwise use any CU or third-party trademarks. Copyright and DMCA Policy. As we ask others to respect its intellectual property rights, CU respects the intellectual property rights of others.

You agree to defend, indemnify and hold harmless CU, its contractors, and its licensors, and their respective directors, members, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Site, including but not limited to your violation of this Agreement. Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the Site will be governed by the laws of the Tijuana, Baja California, excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the state and federal courts located in Tijuana, Baja California. Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute arising under this Agreement shall be finally settled in accordance with the Comprehensive Arbitration Rules of the Judicial Arbitration and Mediation Service, Inc. (“JAMS”) by three arbitrators appointed in accordance with such Rules. The arbitration shall take place in Tijuana, Baja California, in the English language and the arbitral decision may be enforced in any court. The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and attorneys’ fees.
